1.1. Data Fiduciary Identity
This Privacy Policy is issued by Dhyaanway AI Private Limited (the "Company," "We," "Us"). We are the Data Fiduciary responsible for your personal data.

1.2. The Standalone Notice (DPDP Requirement)
Before you use the app, we provide this notice: We collect your data (Phone, Location, Habit Proofs) only to provide habit-tracking and marketplace services. You have the right to withdraw consent at any time.
Your old policy only mentioned "email-id." You must now list everything specifically.

3.2. Metadata Storage: While we don't see the content, we store the "Envelope" (timestamps and sender/receiver IDs) for a period required by IT Rules 2021 to assist in lawful government requests.
We share limited data with the following "Data Processors" who are contractually bound to protect it:
Cloud Infrastructure: Google Firebase / AWS (for data storage).
Payment Gateway: Cashfree Payments (for KYC and funds transfer).
Analytics: Google Analytics & Firebase Crashlytics (for performance).
AI Engine: Third-party LLM providers (to generate your habit insights). Note: We anonymize your data before sending it to AI providers.
5.1. Right to Correction: You can update any wrong information in your profile.
5.2. Right to Nominate: You can choose a "Nominee" who can manage your data in the event of your death or incapacity.
5.3. Right to Erasure (The "Delete" Button):
Self-Service Deletion: You can click "Delete Account" in the app.
Automatic Deletion: If your account is inactive for more than 24 months and you have no pending transactions, we will erase your data automatically, except where needed for tax/legal records.
6.1. Authentication Tokens: We use secure tokens (not browser cookies) to keep you logged in.
6.2. No Tracking of Children: We strictly do not perform any behavioral monitoring or targeted advertising for users under the age of 18.
7.1. Safeguards: We use AES-256 encryption. Your habit logs are stored in a local SQL database on your phone for speed and privacy, then synced to our cloud.
7.2. Breach Notification: If a data breach ever occurs, we will notify you and the Data Protection Board of India within the timeline required by law (usually 72 hours).

Effective as of the date of incorporation, all rights, intellectual property, liabilities, and data fiduciary responsibilities have been transferred to Dhyaanway AI Private Limited. References to "the Company," "We," "Us," or "Our" in this document refer to Dhyaanway AI Private Limited. The Play Store developer name will be updated to reflect this corporate change in due course.
1.1. Legal Entity & Ownership The mobile application "Dhyaanway" (the "App") and the website [Your URL] are owned and operated by Dhyaanway AI Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at [Insert Your Vesu, Surat Office Address] (hereinafter referred to as "the Company," "We," "Us," or "Our").
1.2. Acceptance of Terms By downloading, installing, registering, or using any part of the App, you (the "User," "You," or "Your") expressly agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and any other guidelines posted within the App. If you do not agree, you must immediately cease use and uninstall the App.
1.3. Modification of Terms The Company reserves the right to amend these Terms at any time. Since the App is in active development, we will notify you of significant changes via app notifications or email. Continued use after such changes constitutes acceptance.
1.4. Eligibility & Registration
Age: You must be at least 18 years of age to use the Sponsorship, Transaction, and Marketplace features. Users between 13 and 18 may use habit-tracking features only under the direct supervision of a parent or legal guardian.
Account Accuracy: You agree to provide true, accurate, and current information. Using "bots" or automated methods to create accounts is strictly prohibited.
One Account Rule: Users are permitted to maintain only one active account. Multiple accounts used to "farm" AI tokens or manipulate sponsorships will result in an immediate permanent ban.
2.1. Nature of Service Dhyaanway is a self-improvement and behavioral science tool designed to assist in habit formation. We are not a medical, fitness, or mental health provider.
2.2. No Medical Advice Any content, habit suggestions, or goal-setting templates provided by the App or its AI features are for informational purposes only. They do not constitute professional medical advice, diagnosis, or treatment.
User Risk: You assume all risks associated with the habits you choose to track (e.g., physical exercise, dietary changes).
Consultation: Always consult a qualified healthcare professional before starting a new habit that impacts your physical or mental health.
2.3. The 5-Minute Calendar & Tracking The proprietary calendar format and "Space QR" clock-in systems are provided "as-is." While we strive for 100% uptime for your habit streaks, the Company is not liable for data loss due to technical glitches, server downtime, or sync errors between the App and your device's local SQL database.
2.4. Personal Accountability Success in habit formation depends on the User. The Company makes no guarantees, expressed or implied, that using the App will result in any specific behavioral change or life outcome.
3.1. The "Intermediary" Status In accordance with the Consumer Protection (E-commerce) Rules, 2020, Dhyaanway acts solely as a "Marketplace Intermediary." We provide the technology to connect "Sponsors" with "Users." We do not take ownership of the funds; they are processed via Cashfree Payments (the "Payment Gateway").
3.2. Verification of Milestones (The "Proof of Work") The Sponsorship feature relies on User-uploaded "Proof" (Images/10-second Videos) and verification by a linked "Accountable Partner" (AP).
Finality of AP Decision: You agree that the Accountable Partner is the sole judge of whether a milestone was achieved. The Company will not arbitrate disputes between a User and their AP regarding the "quality" or "truth" of a habit proof.
Fraudulent Proof: Uploading fake images, AI-generated "deepfake" habit proofs, or old videos as "real-time" proof is a breach of contract. The Company reserves the right to freeze the associated wallet and report the user to authorities.
3.3. Payouts and Fees
Cashfree Integration: All payments and payouts are subject to the terms of Cashfree. The Company is not responsible for delays caused by banking networks or the Payment Gateway.
KYC (Know Your Customer): To withdraw any sponsored funds or incentives, Users must complete KYC verification (Aadhaar/PAN) as required by the RBI and our payment partners.
Platform Fee: The Company may charge a service fee/commission on sponsored transactions. This fee is non-refundable.
3.4. No Liability for Sponsor Default If a Sponsor fails to fund a promised milestone due to insufficient balance or card failure, the Company is not legally obligated to pay the User from its own funds.
4.1. Nature of the Messaging Service The "MyCircles" feature allows users to engage in private, real-time messaging. This service is provided as a value-added feature and is subject to the usage limits of your subscription tier (e.g., 300 free chats/month).
4.2. End-to-End Encryption (E2EE) Disclosure Dhyaanway uses E2EE for all private communications. This means the content of your messages is encrypted on your device and can only be decrypted by the recipient.
Our Limitation: The Company does not possess the keys to decrypt your messages. We cannot read, monitor, or intercept the content of your private conversations.
4.3. The "Traceability" & Metadata Clause In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:
Metadata Retention: While we cannot see what you said, we are legally required to store "Metadata" (logs of who you talked to, the time of the message, and your IP address).
Legal Compliance: The Company will comply with valid judicial orders or government mandates to identify the "first originator" of a message to the extent technically possible without breaking encryption, as required for national security or serious criminal investigations.
4.4. Prohibited Content & Safe Harbor You are strictly prohibited from using MyCircles to transmit:
Child Sexual Abuse Material (CSAM), non-consensual intimate imagery, or deepfakes.
Content that threatens the sovereignty of India or public order.
Scams, phishing links, or malware.
Reporting: Users can "Block" and "Report" others. Upon receiving a report, we may suspend the reported user's account based on metadata and user-provided screenshots, even if we cannot read the encrypted logs.
5.1. The AI as an "Assistant," Not an "Expert" The AI features within Dhyaanway are powered by third-party Large Language Models (LLMs). The AI is an experimental tool and is not a human expert, doctor, or legal advisor.
5.2. Disclaimer of Accuracy AI can "hallucinate" or provide incorrect, biased, or outdated information.
No Liability for Advice: The Company is not liable for any physical, mental, or financial harm resulting from a User following advice given by the AI.
Verification: Users must independently verify any "Health Insights" or "Habit Strategies" suggested by the AI before acting on them.
5.3. Prohibited Use of AI You may not use the AI to generate illegal content, hate speech, or to reverse-engineer the Company's proprietary prompt engineering logic.
6.1. The Marketplace Model Dhyaanway is a "Marketplace E-commerce Entity." We provide the platform for Third-Party Sellers (local shops/service providers) to list their inventory.
6.2. Seller Liability
Quality & Description: The Seller is solely responsible for the quality, safety, and accuracy of the goods/services.
Contract of Sale: When you buy a product, the "Contract of Sale" is strictly between You and the Seller. Dhyaanway is not a party to this contract.
6.3. Delivery & "Fallback Liability"
Delivery System: While Dhyaanway provides an integrated delivery tracking system, the actual fulfillment is done by independent delivery partners or the merchant.
Non-Delivery: Under the Consumer Protection (E-commerce) Rules, 2020, we will assist you in resolving non-delivery issues. However, our liability is limited to facilitating a refund from the seller or delivery partner.
6.4. Returns & Refunds Each seller has their own return policy, which must be displayed on their store page. You agree to read these before purchasing.
7.1. Contextual Tracking The QR codes provided for "Spaces" (cafes, studios, homes) are used to analyze behavioral context.
Privacy: Scanning a Space QR logs your location and time. This data is used to provide you with "Habit Analysis" and is stored according to our Privacy Policy.
7.2. Space Hosting & Invitations If you use the App to invite others to a "Space" or "Rent" a space:
No Premises Liability: Dhyaanway does not own or manage these physical spaces. We are not liable for any accidents, injuries, or disputes that occur at a physical location visited via the App.
Host Responsibility: If you "Host" a space, you are responsible for the safety of your guests and compliance with local property laws.
This is your compliance "shield." Under India’s new laws, data is treated with extreme seriousness.
8.1. Data Fiduciary Roles The Company acts as a "Data Fiduciary" under the Digital Personal Data Protection (DPDP) Act, 2023. We determine the purpose of data collection, while you, the User, are the "Data Principal."
8.2. Consent & Purpose Limitation By using the App, you provide Clear, Affirmative Consent for us to process your data specifically for:
Habit Tracking: Storing your streaks and calendar data in your local and cloud SQL databases.
Verification: Storing "Proof of Work" (images/videos) to facilitate Sponsorship payouts.
Hyperlocal Services: Using your GPS location to show nearby marketplaces and "Space QR" contexts.
8.3. The Right to Erasure (Deletion) In accordance with Section 12 of the DPDP Act, you have the right to withdraw consent at any time.
The Process: You can trigger a full data wipe via the "Delete My Account" button in Settings.
Effect: Upon deletion, we will remove all personal data from our active servers within 30 days, except where retention is legally mandated (e.g., transaction records for tax/anti-money laundering laws).
8.4. Reasonable Security Safeguards The Company implements industry-standard encryption (AES-256 for storage and SSL/TLS for transit). However, no digital system is 100% secure. You agree that the Company is not liable for breaches caused by user negligence (e.g., sharing your password or "Accountable Partner" access).
9.1. Ownership of Assets All software code, algorithms, "Space QR" generation logic, 5-minute interval calendar designs, and the "Dhyaanway" brand name/logo are the exclusive property of Dhyaanway AI Private Limited.
9.2. Limited License to Use We grant you a personal, non-exclusive, non-transferable, and revocable license to use the App. You shall not:
Copy, modify, or create derivative works of our UI (even if it "feels" like a calendar you've seen elsewhere).
Reverse-engineer or "scrape" the App's source code.
Use our "Space QR" system to build a competing behavior-tracking database.
9.3. User-Generated Content (UGC) You retain ownership of the photos/videos you upload as "Proof of Work." However, you grant the Company a royalty-free, worldwide license to host and display this content only to your selected "Accountable Partner" and "Sponsor" to fulfill the app's core function.
10.1. Disclaimer of Warranties The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the App will be error-free or that your "Habit Streaks" will never be lost due to technical failures.
10.2. Limitation of Financial Liability To the maximum extent permitted by law (Indian Contract Act, 1872), the total liability of Dhyaanway AI Pvt Ltd for any claim arising out of these terms shall not exceed the total amount you paid to the Company in the 6 months preceding the claim. If you are a free user, our liability is capped at ₹1,000.
10.3. Exclusion of Indirect Damages We are not liable for "Consequential Losses," such as:
Loss of profits or "Sponsored" income due to a technical glitch.
Reputational damage if a habit proof is rejected by an Accountable Partner.
Any health issues arising from habits you chose to track.
10.4. Indemnification You agree to indemnify and hold the Company harmless from any third-party claims (including legal fees) arising from:
Your breach of these Terms.
Any fraudulent "Proof of Work" you upload.
Your conduct within the "MyCircles" messaging environment.
11.1. Jurisdiction: These terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Surat, Gujarat. 11.2. Grievance Officer: In compliance with the IT Rules 2021, if you have complaints regarding data, content, or payments, contact:

12.1. Nature of Transactions Dhyaanway facilitates "Sponsorships" and "Incentives" which are performance-based. By initiating a transaction, the Sponsor agrees that funds are being committed to a specific behavioral goal.
12.2. Refund Policy for Sponsors
Non-Refundable Commitments: Once a Sponsor commits funds to a User’s goal and the User begins the habit streak, the funds are considered "locked" in escrow. Refunds are not permitted once the habit tracking has started.
Technical Errors: If a transaction fails but money is deducted from the Sponsor's account, the refund will be processed by Cashfree as per their standard 5-7 business day cycle.
12.3. Payout Policy for Users
Milestone Completion: Payouts are only triggered when the "Accountable Partner" (AP) clicks "Verify" on the final habit proof.
The "Verification" Window: Sponsors have 48 hours to dispute a "Verified" habit if they believe the proof is fraudulent. After 48 hours, the payout is final and cannot be reversed.
Wallet Withdrawals: Users can withdraw "Incentives" to their bank account only after completing KYC. Minimum withdrawal limits may apply.
13.1. Non-Professional Advice All "Dhyaanway AI" insights, habit recommendations, and behavioral analysis are generated by automated algorithms. They do not represent the views of the Company and are not a substitute for professional medical, legal, or financial advice.
13.2. Limitation of Accuracy AI can produce "hallucinations" (confident but false statements). The Company does not guarantee the accuracy, completeness, or usefulness of any AI-generated content.
13.3. Assumption of Risk By acting on any suggestion provided by the AI Assistant, you do so at your own risk. Dhyaanway AI Pvt Ltd shall not be liable for any injury, loss, or damage resulting from reliance on AI-generated insights.
